Terms and Conditions of Use
Les p'tits plats d'Audrey is a company based in Haute-Savoie (74) that offers cooking services to individuals, and whose services are mainly:
Home meal preparation
Home cooking class
All orders imply full acceptance of these Terms and Conditions of Use.
1- PRICES
Unless otherwise specified, the prices shown on the www.lesptitsplatsdaudrey.fr website include all taxes and are denominated in euros (€).
Prices include travel within a 15km radius of the company's head office in Domancy (74), the service and cleaning of the kitchen. Beyond 15km, mileage charges apply (see below). Meal preparation errands are not included in the service rates and are the responsibility of the customer.
2- MILEAGE EXPENSES
Rates include travel expenses for services provided within a 15km radius.
Beyond this radius, a supplement of €0.70 (incl. VAT) per kilometer round trip will be charged. The number of kilometers to be covered is calculated on the Viamichelin website. Ex: for a service in Chamonix; Viamichelin Domancy/Chamonix estimate: 50km round trip. Travel costs will be (50-30)*0.70 = 14 euros.
In the case of gift cards, any change of address for the course venue (moving house, change of venue, etc.) may result in additional mileage costs to be paid by the recipient of the gift card.
3-QUOTE AND ET PAYMENT
Once contact has been established by e-mail or telephone to specify the services offered, a quotation is given to the customer. This document specifies all the services offered by Les p'tits plats d'Audrey, as well as the total amount due by the customer. The estimate must be returned signed no later than 48 hours before the service is due to take place, and confirms the service definitively.
Once the service has been rendered, the customer will receive the invoice. This must be paid within 48 hours. Customers can pay for services by bank transfer, Paylib, Paypal, Lydia or cheque.
Non-payment of due dates will result in suspension of the reservation for pre-booking dates, and in late payment penalties equal to 3 times the legal interest rate for post-booking dates.
The performance of any new service may be suspended in the event of late payment of a previous order, notwithstanding the provisions of the present contract.
4-ISSUANCE OF AN ANNUAL TAX CERTIFICATE
The Service Provider undertakes to issue to the customer who has subscribed to the personal service giving entitlement to the tax credit, no later than March 31st of year N+1, a tax certificate showing the sums actually received for the Services performed before December 31st of year N.
5- COMMAND MODIFICATION
For organizational reasons, all requests for changes (number of participants, recipes) must be made at least 3 days before the event.
6- RIGHT OF WITHDRAWAL
In accordance with Article L.221-18 of the French Consumer Code, the customer has a period of 14 days from the date of confirmation of the order on the Site to exercise his right of withdrawal, without having to justify his decision.
The customer shall inform Les p'tits plats d'Audrey of his/her decision to withdraw by sending an e-mail to the following address before the end of the withdrawal period: lesptitsplatsdaudrey@gmail.com.
Les p'tits plats d'Audrey will reimburse the customer for the remaining sums due, after deduction of the part of the Service already carried out, at the latest within 14 days from the date on which it is informed of the customer's decision to withdraw. Les p'tits plats d'Audrey will make this reimbursement by bank transfer to the customer's account.
When the right of retraction is exercised by the customer after the intervention of Les p'tits plats d'Audrey, the customer will not be able to obtain the refunding of any sum on behalf of Les p'tits plats d'Audrey, since the service will have been entirely carried out with its express request and that it gave up its right of retraction at the time of the placing of the order.
In accordance with article L221-19 of the French Consumer Code: 1° The day on which the contract is concluded (...) is not counted in the legal 14-day withdrawal period; 2° The period begins at the start of the first hour of the first day and ends at the end of the last hour of the last day of the period; 3° If this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.
7. CANCELLATIONS, POSTPONEMENTS AND CUSTOMER DELAYS
7.1. Cancellation at the customer's initiative
If the customer is unable to attend, he/she undertakes to inform Les p'tits plats d'Audrey directly and as soon as possible in order to reschedule an appointment.
In the event of cancellation at the customer's initiative, no refund of the cancelled service will be made and the customer will be offered a rescheduled service.
7.2. Cancellation at Les p’tits plats d’Audrey's initiative
If Les p'tits plats d'Audrey is unable to provide the service at the last minute, Les p'tits plats d'Audrey will offer the customer a new time slot.
If Les p'tits plats d'Audrey and the customer are unable to find a new time slot, the service will be terminated at the initiative of Les p'tits plats d'Audrey and the customer will be reimbursed all sums paid.
7.3. Terms and conditions in the event of customer delay
If the customer is late, Les p'tits plats d'Audrey will do its best to prepare all the recipes ordered. However, Les p'tits plats d'Audrey may be obliged not to prepare certain recipes depending on the time remaining. However, Les p'tits plats d'Audrey is committed to a guaranteed minimum, depending on the delay:
Delay of less than 30 minutes : Les p'tits plats d'Audrey will cook the entire chosen formula.
Delay between 30 minutes and 1 hour: Les p'tits plats d'Audrey will cook a minimum of two (2) recipes for the 3-course formula, three (3) recipes for the 4-course formula and four (4) recipes for the 5-course formula.
Delay of more than 1 hour: no minimum recipe guarantee.
No reimbursement will be made in proportion to the number of recipes completed.
8– COMPLAINT
Any complaint or dispute concerning the invoicing cannot be taken into account beyond a period of 8 days after the date of invoicing.
Les p'tits plats d'Audrey is liable for the services invoiced. Any external event of force majeure, accident, general or particular strike releases its responsibility from the sales contract.
9- GIFT CARDS
Gift cards are issued to customers by e-mail after payment of the full price. In this case, the card is activated on receipt of payment and can be used for 1 year. After this period, gift cards become obsolete, or can be reused for 1 month with a surcharge of 50% of their initial value.
10 – MODIFICATION OF TERMS AND CONDITIONS OF USE
Les p'tits plats d'Audrey reserves the right to modify its Terms and Conditions of USE at any time without notice. The applicable conditions will be those in force at the date of the order by the customer.
